The EPA continues to enact significant regulations around emissions from the energy sector, including an April rule requiring coal-fired power plants to capture at least 90% of CO2 emissions.
A petition signed by 25 primarily Republican states had sought to block that regulation, but Washington DC’s Court of Appeals has now upheld the rule, rejecting the block after review.
While petitioners argued the rule exceeded EPA’s powers and would cause significant harm to utilities, the Court unanimously agreed that setting emissions limits is within the EPA’s authority.
The rule, effective since April 25th, sets compliance deadlines starting in 2030. The regulation does not apply to plants retiring by 2032 or earlier and has less strict requirements for those retiring by 2039
